Article 46 - Gross Floor Area - Amend Zoning Bylaw - Citizen Petition

The public hearing is scheduled for February 26. The first publication of the public hearing notice is scheduled for February 6 in the Boston Globe. The effective date typically is the first publication of the public hearing per MGL 40A Section 6: "Section 6. Except as hereinafter provided, a zoning ordinance or by-law shall not apply to structures or uses lawfully in existence or lawfully begun, or to a building or special permit issued before the first publication of notice of the public hearing on such ordinance or by-law required by section five, but shall apply to any change or substantial extension of such use, to a building or special permit issued after the first notice of said public hearing,...."

The petitioner has revised the motion to include an effective date. Approval of the article and the proposed effective date is subject to Town Meeting.

The proposed zoning amendment is:

To see if the Town will vote to jointly amend both Section 135-10.1 of the Zoning Bylaw, to revise the definition of Gross Floor Area to remove the inclusion of basements, and Section 135-4.4.2, to reduce the maximum allowable residential Gross Floor Area; or act in any other manner in relation thereto.
