2024 Zoning Amendments - Annual Town Meeting

The Planning Board held a remote public hearing on Wednesday, February 7, 2024 at 6:00 pm on Zoom, to consider the following proposed amendments to the Lexington Zoning Bylaw Chapter 135 of the Code of the Town of Lexington and Zoning Map as follows for the 2024 Annual Town Meeting. Article 47:    Amend Zoning Bylaw – Signs 

To see if the Town will vote to amend Section 5.2 [Signs] and Section 10.0 [Definitions] of the Zoning Bylaw to update regulations related to signs and add new definitions for certain types of signs; or act in any other manner in relation thereto. Draft Motion language here

Article 48:     Amend Zoning Bylaw – Short Term Rentals 

To see if the Town will vote to amend Section 6.10 of the Zoning Bylaw to modify regulations pertaining to short-term rentals; or act in any other manner in relation thereto. Draft Motion language here

Article 49:      Amend Zoning Bylaw – Permitted Uses and Definitions

To see if the Town will vote to amend Section 3.4 Table 1 (Table of Permitted Uses and Development Standards) and Section 10.0 (Definitions) of the Zoning Bylaw to modernize allowed uses and definitions for eating and drinking establishments; and permit additional uses in commercial zoning districts; or act in any other manner in relation thereto. Article :     Amend Zoning Bylaw – Floor Area Definitions (This article has been withdrawn)

To see if the Town will vote to amend Section 10.0 (Definitions) of the Zoning Bylaw to change the definition of gross floor area to exclude porches and amend definition for net floor area to remove exclusion for porches and child care facilities; or act in any other manner in relation thereto.

Article 50:   Amend Zoning Bylaw – Inclusionary Housing for Village and Multi-Family Overlay District

To see if the Town will vote to amend Section 7.5.12.1 of the Zoning Bylaw to require greater than 10% of a project’s total dwelling units to be inclusionary units for developments in the Village Overlay and Multi-Family Districts to comply with MBTA Communities; or act in any other manner in relation thereto. Draft Motion language here

Article 51:      Amend Zoning Bylaw – Maximum Height for Village Overlay District         

To see if the Town will vote to amend Section 7.5.5.10.a of the Zoning Bylaw, Chapter 135 of the Code of Lexington, to base eligibility for the mixed-use height bonus in the Village Overlay (VO) District on the type of underlying district (residential or commercial), the uses, the floor areas, and the size of the development; or act in any other manner in relation thereto.  Draft Motion language

To see if the Town will vote to Amend the Zoning Map to add the property known as Assessor's Map 88, Lot 73C (507 Bedford Street) as shown on the map on file with the Town Clerk and Planning Board to the Bedford Street North Multi-Family Overlay (MFO) District which is described in Section 7.5 [Village and Multi-Family Overlay Districts] of the Zoning Bylaw; or act in any other manner in relation thereto.
